Pro Bono Australia Pty Ltd ACN 090 770 666 ("Pro Bono Australia") reserves the right to alter, modify or update these Terms and Conditions of Use. Any resale of this information or use for commercial gain is prohibited, except with the permission of Pro Bono Australia.

Copyright in the graphics, design, layout, typography, and expression of information, whether as a compilation or otherwise on the Site is owned by Pro Bono Australia. Pro Bono Australia values your privacy. Although the Site compiles standard log files to measure the Site's traffic, it does not specifically identify any e-mail addresses. The information collected is used to improve the content of the Site and is not shared with other organisations unless that organisation is specifically stated as a site partner.

Pro Bono Australia may use information about your organisation to improve its marketing and promotional efforts, to analyse site usage, to improve our content and product offerings and customise the Site's content, layout, and services. Pro Bono Australia appreciates hearing from you. All efforts will be made to respond to your comments, but Pro Bono Australia cannot guarantee it will do so. Pro Bono Australia makes no warranties, express or implied, about the information in these responses.

You agree that any comments submitted by you to the Site will not violate these Terms and Conditions of Use or any right of any third party, including copyright, trademark, privacy or any other right, and will not cause injury. You agree that comments submitted by you to the Site will not contain unlawful material or contain software viruses or any form of "spam".

Advertising Terms and Conditions of Use

Advertisers on the Site agree to the following terms and conditions:

1. Prices set by Pro Bono Australia may vary without notice.

2. Prices listed on the Site are valid from 13 February 2006 and include GST.

3. All amounts owing to Pro Bono Australia must be paid within 14 days of the date of invoice notwithstanding any errors or omissions in any advertisement placed on the Site. Pro Bono Australia may charge interest on late payment at the rate of 12.5% per annum.

4. Advertisers must pay the amount of all invoices in full notwithstanding any errors or omissions in any advertisement.

5. Pro Bono Australia reserves the right to reject or withdraw without notice to the contributor any advertisement that is or appears to be contrary to any law.

6. The advertiser indemnifies Pro Bono Australia, its officers, employees and agents against all claims, actions, suits, liabilities, costs and expenses incurred on any account by Pro Bono Australia as a result of the listing or intended listing of any advertisement by that advertiser on the Site or any related site.

7. Pro Bono Australia makes every effort to avoid errors in advertisements and to remedy any errors in a timely manner. However, it accepts no responsibility or liability for any errors and require that advertisers check their advertisements for errors as soon as they are placed on the Site.

8. Pro Bono Australia reserves the right to either reject or remove any advertisement from theSite for any reason whatsoever.

9. Pro Bono Australia is not liable for any loss or damage incurred by an advertiser as a result of any failure or delay in listing an advertisement.

10. Advertisers must ensure that all advertisements submitted to the Site comply with all applicable legislation, regulations or codes of conduct, including but not limited to the Trade Practices Act 1974 (C'th) and the Fair Trading Acts in all applicable States and Territories.
11. Advertisers agree that pursuant to Sections 18K(1)(b) and 18N(1)(b) of the Privacy Act 1988, Pro Bono Australia may, for the purposes of assessing an Advertiser's commercial credit application, obtain from either a credit reporting agency or other credit providers, personal credit information about the Advertiser and/or its directors.

12. Advertisers agree that pursuant to Section 18K(1)(h) of the Privacy Act 1988, Pro Bono Australia may obtain a consumer credit report about the Advertiser from a credit reporting agency for the purposes of collecting overdue payments relating to commercial credit owed by the Advertiser.

13. Pro Bono Australia reserves the right and Advertisers must accept as a condition of advertising on the Site, Pro Bono Australia's right to re-classify advertisements posted to the Site, entitling Pro Bono Australia to withdraw advertisements from one category of its Site and to re-publish advertisements on another category on its Site.

14. This agreement is governed by the laws of Victoria. Advertisers irrevocably and unconditionally submit to the non-exclusive jurisdiction of the Courts of Victoria, and waive any objection to legal action being brought in those Courts on the grounds of venue or inconvenient forum.
